NCP officially takes over the multi-storey car-park at Ashford at the end of March. I think it might be a good idea to ask when they will reduce the price so it is the same as or less than Ebbsfleet which, at £8 is almost one third less than Ashford charge of £11.50 per day.

Eurostar / Les rames n’étaient pas équipées pour l’hiver
Selon les fiches de procédure pour la maintenance des rames Eurostar, la winterisation (préparation pour l’hiver), qui comporte notamment la pose d’écrans pare-neige, soit par l’atelier du Landy, soit par celui de Temple Mills, devait être faite entre septembre et novembre 2009. A notre connaissance, elle n’a été faite qu’après les incidents du 19 décembre et des jours suivants. Claude Gressier et Christopher Garnett, coprésidents de l’enquête indépendante Eurostar, devraient publier les résultats dans la semaine du 8 février.

According to the procedure forms, for the maintenance of Eurostar trains, the preparation for winter (winterisation), which includes the fitting of anti-snow screens, either at the Landy or Temple-Mills workshops, should have been done between Septembre and November 2009. As far as we are aware, this was only done after the incidents of 19th December 2009 and the days which followed.

WRITTEN QUESTION by Marc Tarabella (S&D) to the Commission

Subject: Inconvenience to thousands of passengers as a result of irresponsible management of Eurostar, with reference to Regulation (EC) No 1371/2007, which entered into force on 3 December 2009

In the night of 18 to 19 December 2009, Eurostar’s 9053 train service from Paris to London arrived in London 12 hours late after a journey in appalling conditions, in which passengers were left entirely to their own devices without any assistance whatsoever.

In the light of the above, can the Commission answer the following questions:

1. How does it intend to enforce full implementation of Regulation (EC) No 1371/2007(1) on rail passengers’ rights and obligations, which entered into force on 3 December 2009 and imposes a number of obligations on railway undertakings in terms of their responsibilities to clients, including the right to compensation of 50 % of the ticket price in the event of delays (Article 17) and a requirement to provide minimum information before and during the journey (Article 8) as well as personal assistance to passengers (Article 18)?

Depuis le 3 décembre 2009 le règlement 1371/2007[1] accorde aux passagers ferroviaires certains droits dont ceux mentionnés par l’honorable parlementaire. L’application stricte de ce règlement doit être assurée par un ou plusieurs organismes indépendants désignés par chaque Etat membre. Ces organismes prennent les mesures nécessaires, notamment des sanctions, pour garantir le respect des droits de voyageurs. Le rôle de la Commission est de s’assurer que ces organismes indépendants s’acquittent de leur tâche et interprètent le règlement de façon cohérente.

Suite aux incidents de décembre 2009, la Commission a contacté les organismes compétents français et britanniques. L’organisme britannique - qui n’est pas encore officiellement désigné par le gouvernement britannique – a déjà indiqué qu’il mènera une enquête sur la bonne application par Eurostar et Eurotunnel de la législation relative à la santé et la sécurité des voyageurs. En outre, la Commission a été en contact avec la société Eurostar pour évaluer les mesures de compensations financières qui ont déjà été offertes aux passagers victimes des incidents, ainsi que pour améliorer à l’avenir l’information et l’assistance des usagers dans des situations de ce type. A ce stade, la Commission n’a pas d’information et n’a pas reçu de plaintes de passagers qui indiqueraient qu’Eurostar n’aurait pas octroyé ou proposé de compensation, comme le prévoit le règlement n°1371/2007. L’analyse est toutefois toujours en cours et celle-ci ne pourra être complétée que lorsque la Commission disposera des résultats de l’enquête menée par l’organisme britannique charger de veiller à la bonne application du règlement.

Sorry, I haven’t got round to translating all this but Reg 1371 is summarised below.
Guarantee disabled persons and persons with reduced mobility non-discriminatory access to trains and assistance Strengthen rail passengers’ right to compensation when their luggage gets lost or damaged (up to about €1285 per piece of luggage) Strengthen rail passengers’ right in case of death or injury through an advance payment to meet immediate economic needs. This advance payment amounts to at least €21000 per passenger in the event of death. Reinforce rail passengers’ right to compensation in case their journey gets delayed or cancelled; the minimum compensation amounts to 25% of the ticket price for delays between one and up to two hours and to 50% of the ticket price for delays of two hours and more. Give rail passengers the right to be informed comprehensively before and during their journey, for example about delays Make it easier for rail passengers to buy tickets Impose the obligation on rail companies and station managers to ensure passengers’ personal security in railway stations and on trains Oblige rail companies to set up a complaint handling mechanism for the rights and obligations covered by the new regulation Oblige Member States to ensure that passengers can lodge a complaint to an independent body, if passengers consider that their rights have not been correctly implemented. Extend the existing rights of passengers under the Convention for the International Carriage by Rail (COTIF) which only covers international transport, in principle, to all domestic train services.

We, as regular Eurostar passengers, wish to help save Eurostar from a decision that will undermine their existing customer base and their reputation.
